Find Injury Care (“Find Injury Care,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, protect, and retain information when you use our website, platform, applications, provider profiles, appointment-request services, communications, advertising services, and related technology (collectively, the “Platform”).

Our Commitment to Your Privacy

We design our services to protect user confidentiality. We do not sell patients’ personal information as a patient-lead product and do not configure advertising tools to capture protected health information.

1. Information We Collect

Depending on how you use the Platform, we may collect the following categories of information:

A. Information You Provide

This may include:

  • Telephone number;
  • ZIP code, city, state, or other location information;
  • Account credentials;
  • Appointment-request information;
  • Provider preferences;
  • Communications with us;
  • Information submitted through forms;
  • Payment and billing information where applicable; and
  • Other information you voluntarily provide.

B. Information About Your Care Request

When you use certain features of Find Injury Care, we may ask you to select the general reason for seeking care, such as whether your request relates to a work-related injury or a motor vehicle accident.

This information is used to help process your request and connect you with the provider or practice you select. We do not require users to provide detailed medical histories, diagnoses, medical records, or treatment information through this feature.

C. Provider Information

For healthcare providers, we may collect or display:

  • Provider name;
  • Practice name;
  • Specialty;
  • Professional credentials;
  • License information;
  • Practice address;
  • Telephone number;
  • Website;
  • Services;
  • Provider-reported insurance participation;
  • Hours;
  • Photos;
  • Appointment information;
  • Profile information; and
  • Other professional information.

Some provider information may be obtained from public sources or directly from providers.

2. How We Use Information

We may use information to:

  • Operate and provide the Platform;
  • Create and manage accounts;
  • Display provider profiles;
  • Facilitate provider searches;
  • Facilitate appointment requests;
  • Communicate appointment-related information;
  • Respond to inquiries;
  • Provide customer support;
  • Process payments;
  • Provide provider profile and marketing services;
  • Manage advertising campaigns;
  • Improve Platform functionality;
  • Monitor security and prevent fraud;
  • Maintain technical systems;
  • Comply with legal obligations; and
  • Enforce our Terms and policies.

We will not use protected health information for advertising or other purposes in a manner prohibited by applicable law.

3. Patient Choice and Provider Selection

Find Injury Care allows users to search for and independently select healthcare providers.

When a user chooses to contact or request an appointment with a particular provider, information necessary to process that request may be transmitted to that provider or the provider’s authorized service providers.

Users should review the provider’s own privacy practices and notices because the provider may maintain medical information separately from Find Injury Care.

4. Appointment Information

If you submit an appointment request, we may share information reasonably necessary to process that request with the provider you selected and applicable service providers supporting the appointment process.

The provider may separately collect and maintain medical information as part of the healthcare relationship.

5. Telehealth

If telehealth functionality is available, certain information may be processed to facilitate the appointment and connection between the patient and healthcare provider.

If a third-party telehealth provider is used, information processed through that service may also be subject to the third party’s privacy policy and applicable contractual arrangements.

Find Injury Care does not itself provide medical diagnosis or treatment.

6. Payment Information

Payments may be processed by third-party payment processors.

Where payment information is processed by a third-party payment provider, the provider may process payment-card information in accordance with its own privacy policy and security practices.

Find Injury Care generally does not need to store complete payment-card numbers on its own systems.

7. Cookies and Similar Technologies

We may use cookies, pixels, analytics technologies, log files, and similar technologies to:

  • Operate the Platform;
  • Remember preferences;
  • Understand website usage;
  • Measure advertising performance;
  • Detect security issues; and
  • Improve the user experience.

Because healthcare-related information can be sensitive, we take additional care regarding tracking technologies used on pages or features where users may submit health information.

We will not knowingly configure third-party advertising or analytics technologies to receive protected health information in a manner prohibited by applicable law.

Users may be able to control certain cookies through browser or device settings and, where offered, our privacy preferences.

8. Advertising and Marketing

Find Injury Care may advertise its services through search engines, social-media platforms, and other advertising networks.

We may also provide digital marketing and advertising services to healthcare providers.

Provider advertising services are designed to promote the provider’s practice or profile and do not constitute a guarantee of patients, appointments, medical outcomes, or insurance reimbursement.

We do not sell patients’ personal information as a patient-lead product.

9. Information Sharing

We may disclose information:

  • To a healthcare provider selected by the user;
  • To service providers that support our operations;
  • To payment processors;
  • To hosting and infrastructure providers;
  • To security and fraud-prevention providers;
  • To communications providers;
  • To telehealth technology providers where applicable;
  • To professional advisers;
  • To comply with legal obligations;
  • To protect the rights, safety, and security of users or the Platform; or
  • With your authorization where required.

Where a vendor handles protected health information on behalf of a covered entity and is acting as a Business Associate or subcontractor, applicable Business Associate Agreements and HIPAA requirements will apply.

10. Business Associates and HIPAA

Find Injury Care’s HIPAA status depends on the specific services provided, the information processed, and the relationship between Find Injury Care and healthcare providers.

Where Find Injury Care acts as a Business Associate, or where a service provider acts as a Business Associate or subcontractor, the parties will use appropriate contractual and security safeguards as required by applicable law.

HIPAA does not apply identically to every piece of information handled by the Platform.

Healthcare providers may have separate HIPAA Notices of Privacy Practices that govern the providers’ use and disclosure of protected health information.

11. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, disclosure, alteration, destruction, or loss.

Depending on the service, safeguards may include:

  • Encryption;
  • Access controls;
  • Authentication;
  • Role-based permissions;
  • Logging and monitoring;
  • Secure infrastructure;
  • Backup and recovery controls;
  • Security testing; and
  • Vendor security controls.

No electronic system can be guaranteed to be completely secure.

12. Data Retention

We retain information for as long as reasonably necessary for the purposes described in this Privacy Policy, to provide services, maintain business and transaction records, comply with legal obligations, resolve disputes, prevent fraud, and enforce agreements.

Where healthcare providers maintain medical records, those records may be subject to separate legal retention requirements applicable to the provider.

  • Request correction of inaccurate information;
  • Request deletion where legally available;
  • Request information about certain disclosures;
  • Withdraw consent where consent is the legal basis for processing;
  • Object to certain processing;
  • Request restriction of certain processing; and

The Platform may contain links to healthcare providers, insurers, telehealth companies, payment providers, or other third-party websites.

We are not responsible for the privacy practices of third-party websites.

You should review the applicable third-party privacy policy before submitting information.

16. Changes to This Privacy Policy

We may update this Privacy Policy periodically.

If we make material changes, we may provide notice through the Platform or other reasonable means.

The revised Privacy Policy will state its effective date.
